Pet Service Agreement (PSA)
This agreement, made and entered into as of the date the terms were accepted by and between Happy Tails Pet Care (hereinafter referred to as “Happy Tails Pet Care”) and Releaser/Indemnitor (hereinafter referred to as “Owner”).
For and in consideration of a set fee to Owner as specified in Happy Tails Pet Care's Work Order, Happy Tails Pet Care agrees to provide loving care for the pets specified in such Work Order. Such care to include, but not be limited to, the following: pet care, watering plants as necessary, collecting mail/paper, rotating lights and blinds, and medications as noted on Happy Tails Pet Care's Work Order. Additional fees may be charged by Happy Tails Pet Care to Owner for additional services requested by Owner and noted on Happy Tails Pet Care's Work Order. There will be an additional late-night charge of $10.00 for requested visits after 9:00 PM. Emergency calls between Midnight and 6:00 A.M. will be at DOUBLE the listed per visit rate regardless of the cause of the emergency. Owner will provide all food and supplies. Happy Tails Pet Care reserves the right to purchase additional food and/or supplies for pet(s) if needed. Owner agrees to reimburse Happy Tails Pet Care for said additional food and/or supplies which may require Happy Tails Pet Care charging the credit/debit card listed below.
It is understood and agreed between Owner and Happy Tails Pet Care that this agreement contemplates that Owner will be in need of Happy Tails Pet Care's services from time to time in the future, and it is further understood and agreed that the obligations and covenants contained herein shall apply to each provision of services in the future, without the need of entering into another agreement, unless altered in writing and signed by the parties herein. Owner will be notified of any price changes prior to new bookings.
It is also hereby agreed that Owner will provide keys and any necessary access codes, properly secured, to Owner's property until such time as Owner ends services. Keys will ONLY be returned in person to Owner, to Owner's authorized representative.
In the event of an emergency involving the health of any pet being cared for by Happy Tails Pet Care, Owner hereby authorizes Happy Tails Pet Care to obtain such emergency veterinarian care by veterinarian specified by Owner for Owner's pet(s) as Happy Tails Pet Care may deem necessary. Owner further authorizes Happy Tails Pet Care to incur veterinarian costs in the name of Owner. Owner agrees to indemnify and hold harmless Happy Tails Pet Care from any liability arising from such veterinary charges. Owner may incur an additional cost if Happy Tails Pet Care must transport pet(s) to veterinarian or wait at veterinarian. Unless specified in writing by Owner in the Client Information Sheet, Owner warrants that its pet(s) are current with all of their shots and vaccinations.
Happy Tails Pet Care's insurance company shall be wholly liable for all claims of injury, death, damage or loss to Owner's pet(s) or property. As further consideration for the services rendered, Owner agrees to waive and release Happy Tails Pet Care and/or their representatives from any claim for injury, loss, and/or death of Owner's pet(s) and from any claim for loss and/or damage to Owner's property including, but not limited to, that caused by Owner's pet(s). Owner agrees to be responsible for any claim for injury, loss, and/or death of representative of Happy Tails Pet Care caused by Owner's pet(s) and/or Owner's property. Owner agrees to be responsible for any damages done at home of any Happy Tails Pet Care representative by Owner's pets at time of boarding, day or evening care performed at the home of Happy Tails Pet Care representative. If Owner specifically requests that their dog be walked/exercised off-leash, Owner agrees to reimburse Happy Tails Pet Care for up to $500 insurance deductible if a claim is to be submitted for injury/damage sustained while their dog was off-leash. Owner agrees to contract work directly through Happy Tails Pet Care, and not privately with any Happy Tails Pet Care representative, during and for a period of two years following the last date of service performed by any representative of Happy Tails Pet Care.
For the safety and well-being of your pet(s) and the security of your property, third parties are absolutely NOT permitted on the Owner's premises under the terms of this agreement. Therefore, all parties agree that no other person(s), including Owner's friends, family members and other third-party contractors, shall have access to Owner's pet(s) and/or property during the dates of service except Happy Tails Pet Care and their representatives. Persons that need to be on the property, will be listed on Happy Tails Pet Care's Work Order prior to Owner's departure. Happy Tails Pet Care's insurance company may not be liable for any claim of injury, death, damage or loss to Owner's pet(s) or property if any third parties are on Owner's premises during the term of Happy Tails Pet Care's pet care assignment.
Pet and home care fees will be incurred by Owner and will be charged by Happy Tails Pet Care to Owner's credit/debit card provided to our office at the completion of all said care listed on the Work Order. A $10 late fee will be incurred if amount owed is not received by Happy Tails Pet Care within 10 days of the end of the service and will continue each month thereafter until paid. A “Return Check Charge” of no less than $25 will be incurred for all returned checks. A cancellation charge of 25% of assignment will be applied for assignments cancelled less than 48 hours of assignment starting date. A cancellation charge of 50% of assignment will be applied for assignments cancelled within 24-hours of assignment starting. A one-time consultation charge of $25 will be applied if a consultation is made but the assignment cancelled.
Any declaration of dissatisfaction with service and/or request for refund must be done within 10 days after completion of service. Refunds will be determined between both Owner and Happy Tails Pet Care and shall be a reasonable amount within the scope of the total cost indicated in the Service Confirmation / Work Order.
Owner agrees to pay a Placement & Referral Fee if Owner directly employs or contracts with any Happy Tails Pet Care domestic worker, independent contractor, former domestic worker, former independent contractor, employee or former employee of Happy Tails Pet Care for a period of Three Hundred and Sixty Five (365) days following the date which Owner last used said worker, contractor or employee for services rendered by Happy Tails Pet Care. In such instances, Owner agrees to pay a fee to Happy Tails Pet Care in the amount of the greater of Five Thousand Dollars ($5,000.00) OR the amount equivalent to one hundred percent (100%) of all revenues earned in the previous Three Hundred and Sixty Five (365) days from the date of said occurrence as a Placement and Referral Fee.
This contract is governed by the laws of the state of North Carolina and any actions by the parties to enforce the terms of the contract must be brought in a court of competent jurisdiction in the city of Charlotte state of North Carolina. The prevailing party in any legal action brought under this agreement is entitled to recover their reasonable attorney's fees and costs from the other party.
It is hereby understood that Happy Tails Pet Care will charge the credit/debit card listed below for pet sitting fees and incurred charges. It is also understood that all fees paid are non-refundable, however a non-transferable credit may be issued by Happy Tails Pet Care and held on file for all unused visits for a period of 12 months from date of notification of cancellation. Owner is responsible for attorney's costs for any legal action necessary for enforcement of this agreement.

This SMS and Mobile Phones Addendum ("Addendum") is hereby incorporated into the existing Terms and Conditions ("Terms") of [Your Company Name] ("Company," "we," "our," or "us") and applies to all users ("User," "you," or "your") of our services, including but not limited to mobile applications, websites, and any related services (collectively, the "Services").

You may opt out of receiving promotional messages by replying "STOP" to any promotional SMS you receive. However, you acknowledge that opting out of account-related or transactional messages may affect your ability to use certain features of our Services.
**4. Mobile Phones and Data Security**
4.1. You are responsible for the security of your mobile device and the information stored on it. You agree to take reasonable precautions to protect your mobile device from unauthorized access, loss, or theft.
4.2. In the event of a lost or stolen mobile device, you must promptly notify us to suspend access to your account.
**5. Disclaimer of Liability**
5.1. We will make reasonable efforts to deliver SMS messages accurately and promptly. However, we are not responsible for delays, errors, or omissions in the transmission or content of SMS messages.
5.2. We are not liable for any loss or damage that may arise from the use of SMS or mobile phones in connection with our Services, including but not limited to loss of data, unauthorized access, or communication failures.
**6. Updates to this Addendum**
We reserve the right to update and modify this Addendum at any time, without prior notice, to reflect changes in our Services or applicable laws and regulations. It is your responsibility to review this Addendum periodically.
